An Agent Keeping Anything Above The Agreed Sale Amount

Question

A asks B to sell a phone for him for R5000 and says that if you sell it for more than R5000, then the extra amount is yours. Is this permissible? If B tells A that if I sell it for more than R5000 then the extra amount will be mine and A agrees will it be permissible?

Answer

A asks B to sell a phone for him for R5000 and they mutually agree that whatever sale is made over and above R5000 will be for person B.

This type of commission is permissible as has been mentioned by Hadhrat Mufti Mahmood Hasan Gangohi Rahimahullah in Fataawa Mahmudiyah that:

“The owner (of the item) should say (to the broker) sell this item for as much as you wish. You just give me 100 Rupees”. 

Therefore, in your case, where A has told B to sell the item for R5000 and keep the money made above the mentioned price, this will be permissible.
