Question
Can the Wasiy (executor of the estate) appoint someone else to make distribution of the estate, even if that person is an heir? What if all the heirs agree to it and are happy with it?
Answer
If the current executor appoints an heir as his executor (to attend to the distribution of the estate) then doing so will be acceptable, more so when the rest of the heirs are happy with it.
( ووصى الوصي ) سواء أوصى إليه في ماله أو مال موصيه وقاية ( وصى في التركتين ) خلافا للشافعي (رد المحتار ص706 ج6)
قَوْلُهُ وَوَصِيُّ الْوَصِيِّ ) أَيْ وَإِنْ بَعُدَ كَمَا فِي جَامِعِ الْفُصُولَيْنِ أَيْ بِأَنْ أَوْصَى هَذَا الثَّانِي : إلَى آخَرَ وَهَكَذَا ( قَوْلُهُ سَوَاءً أَوْصَى إلَيْهِ فِي مَالِهِ أَوْ مَالِ مُوصِيهِ ) يُوَافِقُهُ مَا فِي الْمُلْتَقَى حَيْثُ قَالَ : وَوَصِيُّ الْوَصِيِّ وَصِيٌّ فِي التَّرِكَتَيْنِ وَكَذَا إنْ أَوْصَى إلَيْهِ فِي إحْدَاهُمَا خِلَافًا لَهُمَا ا هـ لَكِنْ قَالَ الرَّمْلِيُّ الْمَسْأَلَةُ عَلَى أَقْسَامٍ أَرْبَعَةٍ ، لِأَنَّهُ إمَّا أَنْ يُبْهِمَ فَيَقُولَ جَعَلْتُك وَصِيِّي مِنْ بَعْدِي أَوْ وَصِيًّا أَوْ نَحْوَهُ أَوْ يُبَيِّنَ فَيَقُولَ فِي تَرِكَتِي أَوْ يَقُولَ فِي تَرِكَةِ مُوصِيَّ أَوْ يَقُولَ فِي التَّرِكَتَيْنِ ، فَإِذَا أَبْهَمَ أَوْ بَيَّنَ فَقَالَ فِي التَّرِكَتَيْنِ فَهُوَ وَصِيٌّ فِيهِمَا عِنْدَهُمْ خِلَافًا لِلشَّافِعِيِّ وَزُفَرَ
