Breaking An Item Before Paying For It

Question

A person wanted to buy a bottle of juice, before he could pay for it, he dropped it and the bottle broke. Does he have to pay for the juice?

Answer

If the bottle broke while in his possession before he could purchase it, he will be held responsible to pay for the bottle of juice.

(المادة ٢٩٨) . ما قبضة المشتري على سوم الشراء وهو أن يأحذ المشتري من البائع مالا على أن يشتريه مع تسمية الثمن فهلك أو ضاع في يده فإن كان من القيميات لزمت عليه قيمتة وإن كان من المثليات لزم عليه أداء مثله للبائع 

لا يخرج مبيع عن ملك البائع مع خياره) فقط اتفاقا (فيهلك على المشتري بقيمته) أي بدله ليعم المثلي (إذا قبضه بإذن البائع) يوم قبضه كالمقبوض على سوم الشراء .. (قوله: على المشتري بقيمته) لأن البيع ينفسخ بالهلاك؛ لأنه كان موقوفا ولا نفاذ بدون بقاء المحل فبقي مقبوضا بيده على سوم الشراء وفيه القيمة.
