Question
I visited the family that had lost their father
During the visit the surviving 2 sons and 2 daughters (all adults) when asked about the distribution said:
We have given it all to our mother.
Is this allowable in sharia?
Answer
By any person merely stating that he does not require his share or he drops off his share of inheritance does not cause his share to drop off automatically due to his statement. The correct procedure to be adopted is that each heir takes possession of his/her share and then gifts it to the mother.
