Granting Power Of Attorney

Question

Can POA (Power of Attorney) be given to a daughter?

In a case were mother is unwell, can a son and daughter take power of attorney or should it only be the sons?

Answer

When a person grants someone Power of attorney he has in fact made him/her his Wakeel (representative). The only requirements for a person to be appointed as a wakeel is that he/she should be “Aaaqil and Mumayyiz” i.e. He/she should be sane and possess understanding.

Thus it would be correct to grant Power of attorney to a daughter, if she fulfills the above requirement. It would also be correct to grant Power of Attorney to your son together with your daughter; if, again, they are both “Aaaqil and Mumayyiz”

وَأَمَّا الَّذِي يَرْجِعُ إِلَى الْوَكِيلِ فَهُوَ أَنْ يَكُونَ عَاقِلًا، فَلَا تَصِحُ وَكَالَةُ الْمَجْنُونِ، وَالصَّبِيِّ الَّذِي لَا يَعْقِلُ، لِمَا قُلْنَا.
وَأَمَّا الْبُلُوغُ، وَالْحَرِيَّةُ، فَلَيْسَا بِشَرْطٍ لِصِحَّةِ الْوَكَالَةِ، فَتَصِحُ وَكَالَةُ الصَّبِيِّ الْعَاقِلِ، وَالْعَبْدِ، مَأْذُونَيْنِ كَانَا أَوْ مَحْجُورَيْنِ وَهَذَا عِنْدَ أَصْحَابِنَا.

ومن شرط الوكالة: أن يكون الموكل ممن يملك التصرف وتلزمه الأحكام والوكيل ممن يعقل العقد ويقصده . (و) أن يكون الوكيل ممن يعقل العقد) : أي يعقل معناه من أنه سالب بالنسبة إلى كل من المتعاقدين وجالب له؛ فيسلب عن البائع ملك المبيع ويجلب له ملك البدل، وفي المشتري العكس (و) أن يكون بحيث (يقصده) لفائدته من السلب والجلب حتى لو كان صبيا لا يعقل أو مجنوناً كان التوكيل باطلا، وما قيل من أن قوله ” ويقصده” احتراز عن الهازل رده ابن الهمام.
