Question
A person after doing his Waajib Qurbani donates or rather gifts the skin of the Qurbani animal to the owner of the farm where Qurbani was carried out. Once the owner of the skin takes possession of the skin gifted to him, he sell it to a particular person. The funds accrued from the sale of the skin are donated as Lillah to an institution/Darul Uloom.
Is the sale of the skin valid as the normal mas’ala is that selling of Qurbani meat is not permitted.
Is the Lillah donation to the institute in order?
Answer
The laws pertaining to the meat/skin of the Qurbani animal apply to the person offering the Qurbani, hence it is not permissible for him to sell the meat/skin of the Qurbani animal.
It is however permissible for him to gift the meat/skin of the Qurbani animal to whomsoever he wishes.
In the mentioned scenario he has gifted the skin to the owner of the farm. Once the owner of the farm took possession of the skin he could do as he pleases with it, the sale and donation would therefore be in order.
