Question
What is the ruling of performing Maghrib salaah with Jamaat in a place where the Jamaat is read late?
Would it be better to perform Salaah individually or would it be better to wait and perform Salaah with Jamaat?
Answer
It is definitely better to wait and perform Maghrib Salaah with Jamaat at the place where the Salaah is performed with Jamaat even though it may be performed a bit later than at other places. This is because of the virtues and rewards that are mentioned in the Hadith of performing Salaah with Jamaat.
As it is mentioned that, we are not supposed to miss prayers with Jamaat except on two occasions: natural disasters and sickness. This however, is subject to the condition that the delay in the Maghrib Salaah is not too much and there is a valid reason for the delay in the Maghrib Salaah, for instance, to cater for people who are breaking their fasts at Iftaar time in Ramadhaan or on other Mustahab fasting occasions. If the delay is without such a valid excuse, then the Imaam or trustees/committee members of the facility should be approached and made to understand the importance of performing Maghrib Salaah as soon as the time sets in. However, if in spite of approaching these people, they do not heed the advice and they persist on unnecessarily delaying the Maghrib Salaah (more so if the delay is to the extent of bordering close to the time when the red-twilight starts to appear in the western horizon – which is completely unacceptable) and there is no other Masjid nearby where the Maghrib Salaah is performed at the proper time, then one should pray at home and make Jamaat with family members.
Despite the fact that he will lose an immense virtue that is attained in Jamaat performed in the Masjid, we hope from the immense Mercy of Allah that he will still attain the same reward.

أَفْضَلُ فِي السُّنَنِ وَالنَّوَافِلِ الْمَنْزِلُ لِقَوْلِهِ – عَلَيْهِ السَّلَامُ – «صَلَاةُ الرَّجُلِ فِي الْمَنْزِلِ أَفْضَلُ إلَّا الْمَكْتُوبَةَ» ثُمَّ بَابُ الْمَسْجِدِ إنْ كَانَ الْإِمَامُ يُصَلِّي فِي الْمَسْجِدِ ثُمَّ الْمَسْجِدُ الْخَارِجُ إنْ كَانَ الْإِمَامُ فِي الدَّاخِلِ وَالدَّاخِلُ إنْ كَانَ فِي الْخَارِجِ وَإِنْ كَانَ الْمَسْجِدُ وَاحِدٌ فَخَلْفَ أُسْطُوَانَةٍ وَكُرِهَ خَلْفَ الصُّفُوفِ بِلَا حَائِلٍ، وَأَشَدُّهَا كَرَاهَةً أَنْ يُصَلِّيَ فِي الصَّفِّ مُخَالِطًا لِلْقَوْمِ وَهَذَا كُلُّهُ إذَا كَانَ الْإِمَامُ فِي الصَّلَاةِ أَمَّا قَبْلَ الشُّرُوعِ فَيَأْتِي بِهَا فِي الْمَسْجِدِ فِي أَيِّ مَوْضِعٍ شَاءَ فَأَمَّا السُّنَنُ الَّتِي بَعْدَ الْفَرَائِضِ فَيَأْتِي بِهَا فِي الْمَسْجِدِ فِي مَكَان صَلَّى فِيهِ فَرْضَهُ وَالْأَوْلَى أَنْ يَتَخَطَّى خُطْوَةً وَالْإِمَامُ يَتَأَخَّرُ عَنْ مَكَان صَلَّى فِيهِ فَرْضَهُ لَا مَحَالَةَ. كَذَا فِي الْكَافِي وَذَكَرَ الْحَلْوَانِيُّ الْأَفْضَلُ أَنْ يُؤَدِّيَ كُلَّهُ فِي الْبَيْتِ إلَّا التَّرَاوِيحَ، وَمِنْهُمْ مَنْ قَالَ: يَجْعَلُ ذَلِكَ أَحْيَانًا فِي الْبَيْتِ وَالصَّحِيحُ أَنَّ كُلَّ ذَلِكَ سَوَاءٌ فَلَا تَخْتَصُّ الْفَضِيلَةُ بِوَجْهٍ دُونَ وَجْهٍ وَلَكِنَّ الْأَفْضَلَ مَا يَكُونُ أَبْعَدَ مِنْ الرِّيَاءِ وَأَجْمَعَ لِلْإِخْلَاصِ وَالْخُشُوعِ. كَذَا فِي النِّهَايَةِ. عن ابن عمر ان رسول الله ﷺ قال: صلاة الجماعة أفضل من صلاة الفذ بسبع و عشرين درجة – متفق عليه
و الذي يقتضيه لفظ الحديث هو إخراجها عن الوقت لا تأخيرها عن الوقت المستحب و هو المتبادر في حديث أنس “و هذه الصلاة قد ضيعت” عند البخاري و إختاره العيني (معارف السنن ج2 ح95)
ينبغي ان يقيد هذا بما اذا تساوت الجماعتان في إستكمال السنن و الادب. اذا كان امام المسجد يخل ببعض السنن او الواجبات……فجماعة البيت أفضل (الحلبي الكبير ج2 ص185)
وَلَوْ نَامَ أَوْ سَهَا أَوْ شُغِلَ عَنْ الْجَمَاعَةِ فَالْمُسْتَحَبُّ أَنْ يَجْمَعَ أَهْلَهُ فِي مَنْزِلِهِ فَيُصَلِّيَ بِهِمْ(الجوهرة النيرة ج1 ص59)
حتى لو صلى في بيته بزوجته أو جاريته أو ولده فقد أتى بفضيلة الجماعة اهـ كذا في الشرح ولكن فضيلة المسجد أتم (حاشية الطحطاوي ص287)
قَالَ فِي الْقُنْيَةِ اخْتَلَفَ الْعُلَمَاءُ فِي إقَامَتِهَا فِي الْبَيْتِ وَالْأَصَحُّ أَنَّهَا كَإِقَامَتِهَا فِي الْمَسْجِدِ إلَّا فِي الْفَضْلِيَّةِ (منحة الخالق ص366 ج1)
