Question
Now-a-days, disabled persons perform Tawaaf in electric vehicles. If a disabled person is such that he cannot drive this vehicle by himself and a healthy drives the vehicle for him with the Niyyat (intention) of his own Tawaaf, will the Tawaaf of the healthy person be valid?
If not, will this person have to give a Damm?
Answer
The jurists have stated that among the Waajibaat of Tawaaf is that it is necessary for a person who is able to walk to perform Tawaf on foot.
Therefore, keeping this in mind, the Tawaaf that is performed by disabled people on electric vehicles will be valid, but if a healthy person drives a vehicle for a disabled person, his Tawaaf will not take place.
Such a person will have to repeat the Tawaaf whilst in Makkah Mukarramah. If the person left Makkah Mukarramah, it will be compulsory for him to give a Damm.
A simple solution is that the driver should not make the intention of doing Tawaaf and instead make a Niyyat of serving the disabled person.
