Can a Muslim employee claim severance pay?
Answer
It is not permissible for a Muslim employee to claim and demand severance pay. Because severance pay is legally required in South Africa, the employer is generally forced to pay the employee that which he is not entitled to. Even though the law requires the employer to pay the severance pay, as a Muslim, the employee should forego this right and not demand it from his employer. In terms of Shari’ah, an employee is only entitled to be remunerated for the time or tasks assigned to him.
Yes, if a Muslim employer of his own free will wishes to give (as a gift and goodwill gesture) a certain amount to the employee in lieu of his loyalty and years of service, he is at liberty to do so. But the amount that the employer wishes to pay, will be left entirely to his discretion. The employee cannot demand and coerce the employer to pay more than what he is willing to pay as a goodwill gesture.

نا اہلیت کی وجہ سے معزول ہونے والا بقیہ ایام کی تنخواہ کا مستحق نہیں:
سوال: ایک دینی ادارے کے ایک مدرس کو اس کے طرز عمل اور کچھ کمزوریوں کی وجہ سے ادارہ کے لئے نامناسب سمجھتے ہوئے اختتام سال پر رجب کے آخر میں مہتم نے علیحدہ کر دیا اور رجب کی تنخواہ بھی دیدی، اس ادارے کے دستور میں علیحد گی ملازمین کے لئے یہ مشق شامل ہے کہ عام حالات میں معزول کئے جانے والے مدرس کو ایک ماہ پیشتر اطلاع دی جائے گی چونکہ اس ملازم کو نا اہلیت کی بناء پر مجبورا علیحدہ کرنا پڑا، اور کوئی وجہ پیش نظر نہ تھی، اسلئے پیشگی اطلاع دینے کی ضرورت محسوس نہیں کی گئی، کیا شر عاماہ شعبان کی تنخواہ دالازم ہو گا یا نہیں؟ بینوا توجروا۔
الجواب : اگر مدرس کو واقعہ نا اہلیت کی بناء پر معزول کیا گیا ہے تو وہ شعبان کی تنخواہ کا مستحق نہیں۔ واللہ سبحانہ و تعالی اعلم –
