Question
I am studying in a Madressa. Sometimes we have guests at the madressa and all the students are also given dawat. Alhamdulillah, I am well aware of the ibahat-tamleek mas’alah. However, my question is that if the food is left it will go to waste, in such a scenario will it be permissible for the students to take the food to their quarters?
Answer
The enquired Mas’ala is based on the discretion of Madrasah’s administration; consequently, if they allow, it will be permissible; otherwise, not. In this scenario, you are required to enquire from the administration if they allow it or not.

حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ الْخَلاَّلُ، حَدَّثَنَا أَبُو عَامِرٍ الْعَقَدِيُّ، حَدَّثَنَا كَثِيرُ بْنُ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ عَوْفٍ الْمُزَنِيُّ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ “ الصُّلْحُ جَائِزٌ بَيْنَ الْمُسْلِمِينَ إِلاَّ صُلْحًا حَرَّمَ حَلاَلاً أَوْ أَحَلَّ حَرَامًا وَالْمُسْلِمُونَ عَلَى شُرُوطِهِمْ إِلاَّ شَرْطًا حَرَّمَ حَلاَلاً أَوْ أَحَلَّ حَرَامًا ” . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . رواه الترمذي رقم ١٣٥٢
