Trees On A Waqf Land

Question

A brother has purchased a piece of land and donated a section of the land as waqf.

Some trees on the waqf land need to be removed,is the donar allowed to take the trees? If not what can be done with the trees?

Answer

When Waqf is made of a piece of land the trees existing at that time also become part of the Waqf whether the donor intends it or not. Therefore in a case where the trees have to be removed they should be sold and the money then spent on the avenue in which the Waqf was made.
