A Second And Third Talaaq Given Two Months Later


Please advise the status of this Nikaah.

Husband said to his wife in an argument threatening her…” If you don’t stop then I’m going to use the T word”. The argument continued and at the end he said : “Talaaq”

The couple continued to live together normal immediately  (same night). About 2 months later, there was another argument similar. After threatening like previously,  husband said:  “Talaaq Talaaq”

They continued to live together as normal and again after 4 months an argument broke out in which the Husband said: “Talaaq Talaaq”


When the husband uttered the word Talaaq for the first time, one Talaaq took place. Therefore, when he said the word Talaaq twice, two Talaaqs took place. Consequently, she has now became مغلظه  meaning a woman who has been given three Talaaqs by her husband and has become a total stranger to him, she cannot return to her husband unless (after having completed her Iddah of divorce), she marries someone else, consummates the marriage and thereafter if the second husband dies or divorces her and her Iddah passes ; then only can she remarry her first husband. 

It is not permissible from them to stay together, thus they are engaged in Haraam by living together, therefore, they have to separate from each other immediately and make Taubah for living together without Nikaah and being engaged in zina. If they want to remarry, they have to follow the above-mentioned procedure.

(والبدعي ثلاث متفرقة أو ثنتان بمرة أو مرتين)(الدر مع الرد٣/٢٣٢)

* (لا) ينكح (مطلقة) من نكاح صحيح نافذ كما سنحققه (بها) أي بالثلاث (لو حرة وثنتين لو أمة) ولو قبل الدخول (حتى يطأها غيره ولو) الغير (مراهقا) يجامع مثله، وقدره شيخ الإسلام بعشر سنين،(بنكاح) (وتمضي عدته) أي الثاني) الدر مع الرد٣/٤١٣)

*(وأما البدعي) فنوعان بدعي لمعنى يعود إلى العدد وبدعي لمعنى يعود إلى الوقت (فالذي) يعود إلى العدد أن يطلقها ثلاثا في طهر واحد أو بكلمات متفرقة أو يجمع بين التطليقتين في طهر واحد بكلمة واحدة أو بكلمتين متفرقتين فإذا فعل ذلك وقع الطلاق وكان عاصيا.(الهنديه١/٣٤٩)

*وإن كان الطلاق ثلاثا في الحرة وثنتين في الأمة لم تحل له حتى تنكح زوجا غيره نكاحا صحيحا ويدخل بها ثم يطلقها أو يموت عنها كذا في الهداية ولا فرق في ذلك بين كون المطلقة مدخولا بها أو غير مدخول بها كذا في فتح القدير ويشترط أن يكون الإيلاج موجبا للغسل وهو التقاء الختانين هكذا في العيني شرح الكنز.(الهنديه١/٤٧٣)
