A Witness Not Hearing The Words Of The Wakeel When Taking The Girls Permission

Question

If the witness was unable to hear the Wakeel taking consent from the girl, will the Nikaah still be valid?

Answer

It will not matter if the witness was unable to hear the Wakeel, the girl’s consent will be valid.

This is because it is not necessary for witnesses to be present at the time when she gives her consent to a Wakeel to have her married. Hence, if it is valid without any witnesses, it will also be valid even if the witness is unable to hear the conversation, as neither his presence nor absence affect its validity.
