Being Paid/Taking A Remuniration For Leading The Taraweeh Salaah

Question

Is it possible to take money or be paid for leading the Taraweeh Salaah?

Answer

The actual Shari’ee ruling is that it is not impermissible to take a fee for an act of Ibaadat. However, the latter jurists after considering the benefit of Deen have permitted taking a fee for Imaamat and teaching the Quraan Sharif. This envisaged benefit to Deen is not found in leading the Taraweeh Salaah in Ramadaan, hence taking a fee for leading the Taraweeh Salaah is not permitted.

 

Hadrat Buraidah Radiallahu Anhu narrates that Rasulullah Sallallahu alayhi Wa Sallam is reported to have said, “A person who recites Quraan so that he may eat from people will come on the day of Qiyaamah in a manner that there won’t be any flesh on his face.”

( قَوْلُهُ وَلَا لِأَجْلِ الطَّاعَاتِ) الْأَصْلُ أَنَّ كُلَّ طَاعَةٍ يَخْتَصُّ بِهَا الْمُسْلِمُ لَا يَجُوزُ الاسْتِنْجَارُ عَلَيْهَا عِنْدَنَا لِقَوْلِهِ عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ { اقْرَءُوا الْقُرْآنَ وَلَا تَأْكُلُوا بِهِ } وَفِي آخِرِ مَا عَهِدَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى عَمْرِو بْنِ الْعَاصِ { وَإِنْ أُتَّخِذْتَ مُؤَذِّنًا فَلَا تَأْخُذْ عَلَى الْأَذَانِ أَجْرًا } وَلِأَنَّ الْقُرْبَةَ مَتَى حَصَلَتْ وَقَعَتْ عَلَى الْعَامِلِ وَلِذَا تَتَعَيَّنُ أَهْلِيَّتُهُ ، فَلَا يَجُوزُ لَهُ أَخْذُ الْأُجْرَةِ مِنْ غَيْرِهِ كَمَا فِي الصَّوْمِ وَالصَّلَاةِ هِدَايَةٌ

مَطْلَبٌ تَحْرِيرٌ مُهِمْ فِي عَدَمٍ جَوَازِ الاسْتِنْجَارِ عَلَى التَّلَاوَةِ وَالتَّهْلِيلِ وَنَحْوِهِ مِمَّا لَا ضَرُورَةَ إِلَيْهِ .
) قَوْلُهُ وَيُفْتَى الْيَوْمَ بِصِحَتِهَا لِتَعْلِيمِ الْقُرْآنِ إِلَى ) قَالَ فِي الْهِدَايَةِ : وَبَعْضُ مَشَايِخِنَا – رَحِمَهُمُ اللَّهُ تَعَالَى – اسْتَحْسَنُوا الِاسْتِنْجَارَ عَلَى تَعْلِيمِ الْقُرْآنِ الْيَوْمَ لِظُهُورِ التَّوَانِي فِي الْأُمُورِ الدِّينِيَّةِ ، فَفِي الامْتِنَاعِ تَضْيِيعُ حِفْظِ الْقُرْآنِ وَعَلَيْهِ الْفَتْوَى ا هـ ، وَقَدْ اقْتَصَرَ عَلَى اسْتِثْنَاءِ تَعْلِيمِ الْقُرْآنِ أَيْضًا فِي مَتْنِ الْكَنْزِ وَمَتْنِ مَوَاهِبِ الرَّحْمَنِ وَكَثِيرٍ مِنْ الْكُتُبِ ، وَزَادَ فِي مُخْتَصَرِ الْوُقَايَةِ وَمَتْنِ الْإِصْلَاحِ تَعْلِيمَ الْفِقْهِ ، وَزَادَ فِي مَتْنِ الْمَجْمَعِ الْإِمَامَةَ ، وَمِثْلُهُ فِي مَتْنِ الْمُلْتَقَى وَدُرَرِ الْبِحَارِ .

وَزَادَ بَعْضُهُمُ الْأَذَانَ وَالْإِقَامَةَ وَالْوَعْظَ ، وَذَكَرَ الْمُصَنِّفُ مُعْظَمَهَا ، وَلَكِنَّ الَّذِي فِي أَكْثَرِ الْكُتُبِ الاِقْتِصَارُ عَلَى مَا فِي الْهِدَايَةِ ، فَهَذَا مَجْمُوعُ مَا أَفْتَى بِهِ الْمُتَأَخِّرُونَ مِنْ مَشَايِخِنَا وَهُمْ الْبَلْخِيُّونَ عَلَى خِلَافٍ فِي بَعْضِهِ مُخَالِفِينَ مَا ذَهَبَ إِلَيْهِ الْإِمَامُ وَصَاحِبَاهُ ، وَقَدْ اتَّفَقَتْ كَلِمَتُهُمْ جَمِيعًا فِي الشُّرُوحِ وَالْفَتَاوَى عَلَى التَّعْلِيلِ بِالضَّرُورَةِ وَهِيَ خَشْيَةُ ضَيَاعِ الْقُرْآنِ كَمَا فِي الْهِدَايَةِ
