Performing Dhuhr Salaah In Congregation On The Day Of Jumuah

Question

On Jumuah, upon consulting with the Musallees, the Muaddhin performed the Dhuhr Salaah (not Jumuah) because the Khateeb did not come.

Please give the ruling of the above in the situation of a Masjid and secondly in the situation of a Musallah.

N.B. Not the Muaddhain nor any of the Musallees know Arabic nor know how to read Arabic.

Answer

For the validity of the Jumuah Salaah there are certain conditions that should be fulfilled. One of the pre-requisites for the validity of the Jumuah Salaah is the recitation or rendering of the Khutba prior to the Salaah (which is Fardh).

The Khutbah should be delivered before the Jumuah Salaah, with the intention of the Khutba, in the time of Jumuah. Recitation of the Khutbah doesn’t necessarily mean that one should recite the entire Khutbah as written in the Khutbah Kitaabs. Yes, the ideal Khutbah is that Khutbah which is delivered in accordance to the Sunnah. The Sunnah Khutbah includes the praises of Allah Ta’aala, bearing witness to the oneness of Allah Ta’aala and theRisalaat of Rasulullah Sallallahu Alayhi Wa Sallam, Durood upon  Rasulullah Sallallahu Alayhi Wa Sallam, advices, recitation of a verse of the Quraan Sharif, etc.

This means that if the Khateeb stood on the Mimbar and merely uttered Subhanallah or Alhamdulillah with the intention of rendering the Khutbah then too the Khutbah is done and valid even though adopting such a practice is Makrooh. Therefore, if any of the Musallies or the Muazzin had adopted this procedure then Jumuah could have been performed without the need of performing Zuhr Salaah. However, we assume that the congregation was not aware of the Mas’ala.

In this particular case the Jumuah was missed out due to the absence of the Imaam. However, the Musallies should have performed their Zuhr Salaah individually in this case, and not in congregation, omitting the Adhaan and Iqaamat or they could have gone to a nearby Masjid so that they got their Jumuah Salaah. It is Makrooh for the residents of the town to perform Zuhr Salaah on the day of Jumuah in the town in congregation. 

Notwithstanding the above, the Zuhr was performed and will be regarded as valid even though it was Makrooh. The ruling mentioned above does not differ whether the incident occurred in a Masjid or Musallah. If the conditions for the validity of Jumuah are met then Jumuah can be performed in a Masjid as well as Musallah.
