Performing Salaah Without Uttering The Takbeer-e-Tahreemah

Question

A woman had never uttered the words of Takbeer-e-Tahreemah and only raised her hands not knowing that utterance of the Takbeer-e-Tahreemah is Fardh. What is the status of all the Salaah she performed like this?

Answer

فمن فرائضها التي لا تصح بدونها (التحريمة) قائما وهي شرط في غير جنازة على القادر به يفتى (الدر المختار على الرد) (فرائض) نفس (الصلاة ستة) الأول : (التحريمة) قائما؛ لقوله عليه السلام: (مفتاح الصلاة الطهور وتحريمها التكبير وهي شرط عندهما، وفرض عند محمد

قوله: “ويشترط التحريمة” هو قول الشيخين لقوله تعالى : {وَذَكَرَ اسْمَ رَبِّهِ فَصَلَّى}

In the Fiqhul Ibaadaat, the author (Rahimahullah) included Takbir Tahrima among the Faraaidh (obligatory actions) of Salaah and further said, “The ruling on obligatory prayers is that if a Fardh is omitted intentionally or by mistake, the prayer will not be performed, and in both cases, it will be necessary to repeat it.”

Mufti Salman Sahib Mansoor Puri (Rahimuahllah) says in the Kitaabun-Nawaazil, “The utterance of  Tahrima, whether it is with the word “Allahu Akbar” or with the words “Allahu Ajl” and “Allahu Azam” etc.,  is obligatory and a condition for validity. The utterance of Tahrima with the word “Allahu Akbar” is Wajib. Therefore, any prayer that is performed without Takbir-Tahrima will have to be repeated.”

Hence, you are required to estimate all the prayers that have been performed without Takbeer-e-Tahreemah until now and repeat them.
