Selling An Item As Voetstoots

Question

If the seller says – Sold as is – does it fall in the same category as someone who says أنا برئ من كل عيب? 

Can the buyer still return the item if he notices a defect?

Answer

Both phrases “sold as is” and “أنا برئ من كل عيب” signify that the buyer is purchasing the item or property in its current condition, accepting all patent (visible) and latent (hidden) defects, and the seller is exempt from liability for those defects after the sale is complete.

If the buyer accepted the condition of “voetstoots” (buy as is/sold as is), then the buyer cannot return the item if the buyer discovers a defect after the sale is completed
