Question
While on Hajj, it so happened that when we got to Muzdalifah, and after performing our Maghrib and Esha prayers had something to eat and slept our group leader told us to get ready to move and we left Muzdalifah for Mina before Fajr. I was the only Hanafi. I had no alternative but to follow. So as I missed the Wuqoof from Fajr onwards, is Damm wajib on me?
Answer
The time prescribed for the Wuqoof of Muzdalifa is from Subh Saadiq until sunrise. It is Waajib to make Wuqoof at this time. Therefore if one carries out his/her Wuqoof after sunrise the Wuqoof will not be correct.
Similarly, if a person departed from Muzdalifa at night (before Subh Saadiq) as a result omitted the Waajib Wuqoof then Damm will be Waajib.
In conclusion, Damm will be Waajib in your case; thus an animal such as a goat or sheep will have to be slaughtered within the boundaries of the Haram.
