Using Sponsored Burial Items

Question

We learn that all the burial expenses (grave, kafn, etc.) need to be taken out from the estate of the deceased. On the other hand, some things are sponsored for the ghusl e.g. gloves, camphor, etc.

1. Is it necessary to get permission from the heirs of the mayyit to use these items for the deceased?

In our community, one generous brother donates all the timber (planks) needed for the burial. It has been his practice, and before him, another generous brother’s practice to sponsor planks.

2. Is it necessary to get permission from the heirs of the mayyit to use the planks free of charge?

3. May the burial committee use the planks for the burial without informing the family of the mayyit that the planks are sponsored?

Answer

The burial expenses are definitely primarily supposed to be taken out from the wealth and estate of the deceased, however if one wishes to sponsor the items like gloves, camphor etc. with the intention of Sadaqah, and earning the pleasure of Allah Ta’ala then this is permissible, and commendable.

1. The recipient of the donation in this case is the deceased, who obviously cannot accept it himself, therefore those who are representatives on his behalf would be those who are his heirs. Therefore it would be necessary to take permission from them. They should be asked as to whether they want to accept this donation or not. However, if it is the norm of the time, and everyone in the area knows that the items needed for the burial are being sponsored, then it will not be necessary to go and take special permission from the deceased’s family, because in this case permission is understood.
