Cancelling A Contract

Question

Can you cancel a contract if you are not using their services and equipment and cannot afford to pay the service provider?

Answer

In the case of a fixed contract i.e. the period of the contract is stipulated (e.g. 6months /1year contract), payment as per contract is necessary,  irrespective of whether benefit was derived from the services and equipment or not. Such a contract could only be terminated by mutual consent from both parties.

If, however an open contract was made i.e. the time of the termination of the contract was not stipulated (e.g. payment every month without any time stipulated for the termination of the contract) then the first month is binding and thereafter the contract could be terminated, in the presence of the other party, at the end of any month.

فتاوى خليلية ج ١ ص ٣٣٥ طبع سهارنبور (آجر حانوتا كل شهر بكذا صح في واحد فقط وفسد في الباقي لجهالتها، والأصل أنه متى دخل كل فيما لا يعرف منتهاه تعين أدناه، وإذا مضى الشهر فلكل فسخها بشرط حضور الآخر لانتهاء العقد الصحيح ( وفي كل شهر سكن في أوله) هو الليلة الأولى ويومها عرفا وبه يفتى (صح العقد فيه) أيضا، وليس للمؤجر إخراجه حتى ينقضي إلا بعذر ، كما لو عجل أجرة شهرين فأكثر لكونه كالمسمى زيلعي إلا أن يسمي (الكل) أي جملة شهور معلومة فيصح لزوال المانع

رد المحتار (قوله حانوتا مثال؛ لأنه لو استأجر ثورا ليطحن عليه كل يوم بدرهم فالحكم كذلك طوري. قوله) وفسد في الباقي مقيد بثلاثة أمور تعلم مما بعده بألا يسكن فيما بعد الشهر الأول، وأن لا يعجل أجرته وأن لا يسمي جملة الشهور، فإن وجد واحد منها صح فيه .
