Paying For Kaffarah Fasts

Question

I am a 56 year old female… I have 3 kaffarah fast to keep, it is of 3 different years. 

I have a few health issues; listed below 

High blood pressure 
High insulin
High cholesterol 
Underactive thyroid 
*Disc degeneration
*Anterlisthesis of the spine
*Sciatica
*Nerve impingement

Because of the above(marked with Asterisk) I am in constant pain. 

From the 3 kaffarahs I have completed 1 (fasted for 60 consecutive days). 

After the 60 days I experienced weakness.

Since the time I completed the first kaffarah; my pain have also increased. 

Due to all these conditions, can I pay for the kaffarah of the other 2 years or should I keep the fast of the other 2 kaffarah.

 

Answer

Under the circumstances, based on the many ailments that you suffer from, yes, it will be permissible for you to pay the Kaffarah.

فيعتق أولا فإن لم يجد صام شهرين متتابعين فإن لم يستطع أطعم ستين مسكينا(رد المحتار٢/٤١٢)

*(وأما) العجز عن الصيام فشرط لوجوب الإطعام فيما للإطعام فيه مدخل لقوله جل وعلا {فمن لم يستطع فإطعام ستين مسكينا} [المجادلة: 4] أي من لم يستطع الصيام فعليه إطعام ستين مسكينا فلا يجب الإطعام مع استطاعة الصيام، ثم اختلف في أن المعتبر هو القدرة والعجز وقت الوجوب أم وقت الأداء، قال: أصحابنا – رحمهم الله -: وقت الأداء،(بدائع الصنائع٥/٩٧)

*وأما في كفارة الظهار، وكفارة الإفطار في شهر رمضان إذا عجز عن الإعتاق لفقره وعجز عن الصوم لكبره جاز له أن يطعم ستين مسكينا(الهندية١/٢٠٧)

*اگر ضعف یا مرض کی وجہ سے روزہ نہ رکھ سکے تو ساٹھ غریبوں کو دو وقت شکم سیر کھانا کھلائے۔۔۔(محمودیہ١٠/١٧٠)
