Tax Rebate On Zakaat

Question

In respect of zakat payments, how does one justify donation tax refundable from Sars in terms of the amount paid and the amount refundable , is it permissible to apply for section 18A with regards to zakaat paid to an organization? And if it is permissible how does one justify how much was paid for zakaat after the rebate?

Answer

Section 18A for tax exemption was introduced by the government to encourage people to give in charity. Looking at it from this angle, it will be regarded as a gift from the government. The tax rebate will not affect the Zakaat paid by a person, as the person is neither getting back anything from the Zakaat funds that he discharged, nor is he getting any benefit from the organization he paid the Zakaat to and nor is the government benefiting from the Zakaat. Instead, he is receiving (as an incentive to give further charity), a gift from the government after having paid the Zakaat. Hadhrat Mufti Mahmood Saheb (Rahimahullah) says about a person receiving a gift from a person he gave Zakaat to:

معاوضہ تو لینا ناجائز ہے، لیکن اگر قریب مصرف زکوۃ ہے اوراس کو زکوۃ دیتا ہے پھر وہ کوئی شیئ ہدیۃ اس زکوۃ دینے والے کو دیتا ہے تو اسکا لینا درست ہے

To take something in lieu of the Zakaat (at the time of giving Zakaat) is impermissible. However, after giving Zakaat to a relative (who is eligible to receive Zakaat from one), he receives a gift from the relative, it will be permissible for him to take that gift.

From the above-mentioned text, we clearly understand that when a person can take a gift from a person to whom he has given Zakaat to, he should be able to take a gift from a third party or from the government as well. Therefore, it will be permissible to apply for a section 18A certificate and later receive a rebate on income tax. The Zakaat will be discharged fully, nothing will be considered deducted from the Zakaat.

(قوله هي تمليك المال من فقير مسلم غير هاشمي، ولا مولاه بشرط قطع المنفعة عن المملك من كل وجه لله – تعالى -)وأفاد بقوله بشرط أن الدفع إلى أصوله وإن علوا وإلى فروعه، وإن سفلوا وإلى زوجته وزوجها وإلى مكاتبه ليس بزكاة كما سيأتي مبينالا يجوز الدفع إلى أبيه وجده، وإن علا، ولا إلى ولده وولد ولده، وإن سفل؛ لأن المنفعة لم تنقطع عن الملك من كل وجه كما قدمه في تعريف الزكاة؛ لأن الواجب عليه الإخراج عن ملكه رقبة ومنفعة، ولم يوجد في الأصول والفروع الإخراج عن ملكه منفعة وإن وجد رقبة، وفي عبده وجد الإخراج منفعة لا رقبة كذا في المستصفى، وفيه إشارة إلى أن هذا الحكم لا يخص الزكاة بل كل صدقة واجبة لا يجوز دفعها لهم كأحد الزوجين كالكفارات وصدقة الفطر والنذور، وقيد بأصله وفرعه؛ لأن من سواهم من القرابة يجوز الدفع لهم، وهو أولى لما فيه من الصلة مع الصدقة

*وجواز أكل الغني ما تصدق به على الفقير إذا أهداه له وبالبيع أولى وجواز قبول الغني هدية الفقير

زید کا اس فقیر کے یہاں آمد و رفت کرنے اور اسکاتحفہ قبول کرنے میں شرعا کوئی قباحت نہیں ہے ،اور زید کی زکوۃ بھی ادا ہوجائے گی،البتہ زکوۃ ادا کرتے وقت اس کے یہاں جاکر کھانے پینے سے اور اس سے تحفہ تحائف قبولکرنے کی نیت نہ ہونی چاہیے
